1How to stop kids from watching too much TV?  - a., coimbatore

More outdoor sports should be introduced in their life style. They should be made aware of the hazards of watching too much TV.

2If a tenant has occupied the property for 14 years on rent through lease contracts renewed every 11 months, is it difficult to vacate them ? What does the law say regarding leasing of property to tenants ?  - G., DUBAI

It is not difficult to vacate the tenant. He should approach the court of law after termination of tenancy. Taking legal action depends upon the measurement of the tenanted property or on basis of the quantum of monthly rent. The period of tenancy is not an important factor, irrespective of any tenancy years; the landlord can evict the tenant after terminating the tenancy. For further detail it also needed the particulars of measurement of the tenanted premise, monthly rent, is there any breach of terms of tenancy, etc…. are required.

3How can I track my credit card transaction to know if I did it or not?  - a., coimbatore

You can subscribe to mobile alerts that have tie-ups with the banks. These mobile alerts inform you about the transactions made. For example, ICICI Bank sends SMS alerts for every transaction higher than Rs. 2000 done through the card.

4Can anyone recommend professional education resources, whether they be seminars, CLE classes, practice-oriented books etc. on Real Estate Investment Trusts. I am interested primarily in the legal organization and operation of REITs.   - a., coimbatore

Look at SmartBrief.com -- just a few days ago I signed up for a daily newsletter from them on the financial markets and REITs. The email is free and most of the referenced articles are free, so you can get a lot of information. Links:http://smartbrief.com

5Has anyone ever raised funds through the sale of promisory notes using a private placement? If so, what suggestions do you have for increasing visibility to the offering without doing general advertising?   - a., coimbatore

I have not. Whether it is feasible depends on what the funds will be used for and what kind of collateral or guarantee or other type of assurance there is to back up those promises. In general, I think that if you ask financiers to take significant downside risk, they will want to share in an upside as well.

6I am a dual citizenship holder and needs clarification on a issue for which I couldn't find answer in the website. We are getting very good information from your website that to without paying a penny which is really great. My question is, do I need PAN # as required in India for all financial transactions like opening a bank account, buying a property of a car, buying or selling shares or mutual funds, applying for a bank loan, etc. If yes, then what and how to get it?  - a., coimbatore

As an NRI you do not need a Pan Number to open a bank account, buy property or a car. However you do need a Pan Number when purchasing stocks etc. To buy stocks and shares you need what is referred to as a 'demat' account and you must have a Pan Number to open a demat account. Many financial institutions who you bank with in India will also help you get your Pan Number. Axis Bank with whom I have an NRI account helped me get mine without a service charge. All I had to do was sign the required form, give them a photograph and pay the fee of Rupees 67.

7I have been told that US Citizens returning to India should pay dual income tax (USA & India). Is this true? If I return to India after becoming a US citizen and if I choose to work in India, should I file my US & Indian tax return?   - a., coimbatore

I am assuming you are referring to US citizens working in India for their US employers. India and the United States have a tax treaty so that their citizens can avoid double taxation. Where you pay taxes will depend on the number of days in a taxation year that you work in India. Whether its less or more than 183 days. When US citizens pay income tax by filling tax returns in foreign countries with whom the United States has tax treaties, they are given a foreign tax credit when filling their US tax return so as to reimburse them for some of the income tax they paid abroad.

What will be the compensation I would get, is it the Guide Line Value or The FAIR MARKET PRICE prevailing at that time?  - a., coimbatore

10My Grand mother has secured 15 cents of land from her mother. My grand mother is having two sons and a daughter; right now she is in bed (paralysed). Her daughter is taking care of all her needs. We are two brothers and a sister of her elder son who is staying away. Can we have a right on the property of my grand mother or is it that only her daughter has the right on that property?   - a., coimbatore

If the title of the property is in your grand mother's name, at this point of time no one else will have right over the property. As she is having absolute right over the property she can do whatever as her wish.

11Should I have a will?  - s., bangalore

It is always preferable to have a will. A will states your preference as to the disposition of your estate. A will can and should be changed as your circumstances and preferences change. Even if you take measures to avoid probate, you should have a will as a back up. A person who dies with a will is said to have died testate. A person who dies without a will dies intestate. In either case, the person who dies is called the decedent, and the property the person leaves at death is called the his or her estate.

12What happens to my property while I'm in bankruptcy?  - p., bangalore

Generally, after a debtor files for bankruptcy, a creditor may not attempt to collect the debts outside of the bankruptcy proceedings. Similarly, once a piece of property becomes subject to the bankruptcy proceeding, the debtor may not transfer it. In fact, some transfers, liens, or secured interests that occur prior to the proceedings may also be declared invalid.

13What is the difference between common and preferred stock?  - s., Bangalore

Common stock represents the residual interest of the corporation, which means that common shareholders bear the risk of loss and enjoy the benefits of any profits. Holders of preferred stock have preferential rights, often having the right to vote while holders of other classes of stock do not. Holders of preferred stock may also have priority over other shareholders regarding dividend payouts and distributions due to a partial or complete corporate dissolution.

14Can I sue someone for discriminating against me because I am HIV-positive?   - h., bangalore

Yes. HIV is usually considered a disability under several civil rights laws. If you are denied housing, medical or dental care, or service at a place of business based on your HIV status, your civil rights may be violated. If you are harassed at work or if an employer denies you a job, decreases your benefits, fires you or fails to promote you because you are HIV-positive, you also may have grounds to sue for discrimination. See an attorney or local legal aid society for additional information.

15What documentation do I need for a mortgage?  - P., Trichy

If you've spent months searching for the perfect home, the last thing you want are delays in the mortgage approval process. Unfortunately, a delay in getting approved for your mortgage can push back the closing or be a viable reason for the seller to cancel the purchase contract. One problem causing delays is documentation. Even after going through the pounds of paperwork during the mortgage application process, lenders often request more documentation. According to one loan officer, most borrowers don't know exactly how much detailed information the lender will need to approve their loans.
